1. Purpose and Nature of the Service

1.1. The Platform offers technical analysis tools, algorithmic indicators, and an algorithmic alert system (hereinafter, the "Service"), aimed at assisting the User in researching, analyzing, and planning their decisions in financial markets. The Service is provided exclusively for informational, educational, and analytical support purposes.

1.2. The User acknowledges and accepts that the Platform is not a broker, exchange, financial intermediary, investment advisor, investment manager, wealth manager, or capital administrator. The Platform does not execute orders, manage funds, or act as the User's representative before third parties.

1.3. The Service does not constitute financial advice, personalized investment recommendations, public offering, discretionary portfolio management, or guarantee of results. All investment decisions are made exclusively by the User under their own judgment and responsibility.

2. Acceptance of Terms

Accessing, registering for, contracting, paying for, or using the Service implies full reading, understanding, and acceptance of these Terms and Conditions.

By completing the registration process or acquiring an access license, the User agrees to be legally bound by this document.

3. Account Registration and Access

3.1. To use the Service, the User must be of legal age in accordance with the laws of their jurisdiction and provide a valid email address.

3.2. The Platform does not require identity verification processes (KYC), as it does not provide financial or custodial services.

3.3. The User is solely responsible for maintaining the confidentiality of their access credentials and shall be liable for all activity conducted from their account.

4. License of Use

4.1. Access to the Service is granted under a limited, personal, revocable, non-exclusive, and non-transferable license.

4.2. Contracting the Service does not imply the sale or transfer of ownership of the software, algorithms, indicators, strategies, alert systems, documentation, databases, models, or any other intellectual asset of the Platform. The User acquires only a limited right to access and use in accordance with these Terms.

4.3. The license authorizes only personal and non-commercial use of the Service, unless expressly authorized in writing by the Platform.

5. Nature of Alerts

5.1. The alerts generated by the Platform are automated information based on algorithmic systems.

5.2. The alerts do not constitute mandatory instructions, personalized recommendations, financial advice, or guarantees of execution, profitability, or results.

5.3. The User is solely responsible for interpreting and using such alerts in their investment or trading decisions.

5.4. Past performance of a strategy, indicator, or alert does not constitute a guarantee or reliable indicator of future results.

6. Prohibited Use

The User undertakes not to carry out, directly or indirectly, any of the following actions:

  • 6.1. Automation: creating, developing, training, integrating, or using bots, scripts, APIs, Expert Advisors (EAs), copy trading systems, artificial intelligence tools, automated software, or any other mechanism intended to automatically execute, interpret, replicate, or exploit the alerts, indicators, or strategies of the Platform.
  • 6.2. Reverse engineering: decompiling, analyzing, inspecting, reconstructing, decrypting, copying, or attempting to discover the internal workings of the software or algorithms.
  • 6.3. Artificial intelligence: using artificial intelligence models, machine learning, or any automated system for the purpose of inferring, reconstructing, training, or replicating the functioning of the Platform's algorithms.
  • 6.4. Data extraction: collecting, downloading, storing, indexing, extracting, reproducing, or creating databases using the alerts or any information generated by the Platform.
  • 6.5. Redistribution: sharing, reselling, sublicensing, retransmitting, publishing, distributing, or commercializing the alerts, indicators, content, or any part of the Service.
  • 6.6. Derivative services: using the Service to provide signal services, account management, copy trading, financial advice, course sales, capital management, or any other commercial activity based wholly or partially on the Platform.
  • 6.7. Misuse: using the Service for illicit, fraudulent activities, or contrary to applicable regulations.
  • 6.8. Security: attempting to breach, interfere with, damage, or compromise the security, availability, or integrity of the Platform.

Failure to comply with any of these prohibitions may result in immediate suspension or cancellation of access to the Service, without the right to a refund.

7. Payments, Subscriptions, and Licenses

7.1. The Service may be offered through periodic subscriptions or one-time payments.

7.2. Subscriptions will automatically renew until cancelled by the User, unless expressly stated otherwise.

7.3. One-time payments will grant access for the period specified at the time of purchase.

7.4. All payments are final. Taxes, bank fees, or charges derived from the payment method shall be the sole responsibility of the User when applicable.

8. No Refund Policy

8.1. Due to the digital, immediate, and intangible nature of the Service, all payments are final and non-refundable.

8.2. No full or partial refunds will be granted for: lack of use; subjective dissatisfaction; results obtained; early cancellation; suspension due to breach of these Terms; lack of understanding of the Service's operation.

9. Market Risk

9.1. The User acknowledges that trading in financial markets involves a high level of risk, including the possible total loss of invested capital.

9.2. The Platform does not guarantee profits, profitability, recovery of losses, or specific results.

9.3. All transactions executed by the User shall be carried out under their exclusive decision and responsibility.

9.4. The Platform does not participate in the User's decision-making or control the execution of transactions on brokers, exchanges, prop firms, or other entities.

10. Liability and Limitation of Warranties

10.1. The Service is provided "as is" and "as available".

10.2. The Platform does not guarantee: uninterrupted availability; absence of errors; absolute accuracy of information; continuity of the Service; positive financial results; compatibility with brokers, exchanges, prop firms, or third parties.

10.3. Under no circumstances shall the Platform be liable for financial losses, loss of opportunities, loss of profits, loss of funded accounts, blocking by third parties, indirect damages, lost profits, or any harm arising from the use of the Service.

10.4. The total liability of the Platform, where legally applicable, shall be limited to the amount actually paid by the User during the three (3) months immediately preceding the event giving rise to the claim.

11. Third-Party Services

The User acknowledges that they may use brokers, exchanges, prop firms, payment processors, or other third-party services. The Platform does not control or assume any responsibility for such entities, their internal policies, regulatory changes, suspensions, restrictions, blocks, or business decisions.

12. Suspension and Cancellation of Access

12.1. The Platform may suspend, restrict, or cancel access to the Service when it detects: breach of these Terms; misuse of the Service; fraudulent activities; security risks; protection of intellectual property; any conduct that may affect the operation of the Platform or its community.

12.2. Suspension or cancellation shall not create a right to a refund or financial compensation.

13. Intellectual Property

All rights to the software, algorithms, indicators, alert systems, models, documentation, interfaces, design, databases, trademarks, trade names, content, and any other element of the Platform belong exclusively to the Platform or its respective licensors.

Reproducing, modifying, adapting, translating, decompiling, creating derivative works, distributing, commercializing, sublicensing, or exploiting such elements without prior written authorization is prohibited.

14. Modifications to the Service and Terms

The Platform may modify, update, replace, improve, suspend, or discontinue, in whole or in part, the Service, its algorithms, indicators, strategies, functionalities, or characteristics, when it deems necessary for technical, commercial, regulatory, or any other reasons.

Likewise, it may modify these Terms and Conditions at any time. Modifications will be notified through the Platform or by email when applicable.

Continued use of the Service after such modifications come into effect shall imply acceptance of the new Terms.

16. Entire Agreement

These Terms and Conditions constitute the entire agreement between the User and the Platform regarding the use of the Service and supersede any prior agreement, communication, or understanding, whether verbal or written.

If any provision is declared invalid, illegal, or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect. The failure of the Platform to exercise any right provided for in these Terms shall not constitute a waiver of such right.
